A mudan\u00e7a veio com a san\u00e7\u00e3o da Lei n\u00ba 15.377\/2026 pelo presidente Luiz In\u00e1cio Lula da Silva e j\u00e1 est\u00e1 em vigor.<\/p>\n\n\n\n<p>O texto tamb\u00e9m refor\u00e7a um direito que voltou ao debate p\u00fablico: a&nbsp;possibilidade de faltar ao trabalho por at\u00e9 tr\u00eas dias ao ano, sem preju\u00edzo do sal\u00e1rio, para a realiza\u00e7\u00e3o de exames preventivos.<\/p>\n\n\n\n<p>A atualiza\u00e7\u00e3o da lei gerou uma onda de publica\u00e7\u00f5es nas redes sociais, muitas delas afirmando que esse direito teria sido criado agora. No entanto, a&nbsp;<strong>folga remunerada para exames preventivos j\u00e1 existe na CLT desde 2018<\/strong>. O que muda, desta vez, \u00e9 o papel atribu\u00eddo \u00e0s empresas.<\/p>\n\n\n\n<p><strong>\u201cO empregado j\u00e1 podia se ausentar por at\u00e9 tr\u00eas dias a cada 12 meses para realizar exames preventivos de c\u00e2ncer (&#8230;). A Lei n\u00ba 15.377\/2026 n\u00e3o cria esse direito do zero, mas acrescenta um dever de informa\u00e7\u00e3o e conscientiza\u00e7\u00e3o por parte das empresas\u201d, explica o advogado Marcel Cordeiro, s\u00f3cio da \u00e1rea de Direito Trabalhista e Previdenci\u00e1rio do escrit\u00f3rio Miguel Neto Advogados.<\/strong><\/p>\n\n\n\n<p>Na pr\u00e1tica, a nova lei faz com que o direito deixe de depender apenas da iniciativa do trabalhador e passe a ser uma&nbsp;<strong>informa\u00e7\u00e3o que precisa circular no ambiente de trabalho<\/strong>.<\/p>\n\n\n\n<p>A partir de agora, as empresas devem divulgar campanhas de vacina\u00e7\u00e3o, promover campanhas de informa\u00e7\u00e3o e orienta\u00e7\u00e3o sobre HPV e c\u00e2ncer e orientar funcion\u00e1rios sobre como acessar exames preventivos.<\/p>\n\n\n\n<p>Essa mudan\u00e7a pode parecer discreta, mas tem efeito direto na rotina. Ao transformar a informa\u00e7\u00e3o em obriga\u00e7\u00e3o, a lei tenta resolver um problema comum:&nbsp;o direito existe, mas nem sempre chega a quem pode utiliz\u00e1-lo, segundo o Senado Federal.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Como funciona a folga para exames?<\/h2>\n\n\n\n<p>Do ponto de vista pr\u00e1tico, as regras continuam simples. O trabalhador&nbsp;<strong>pode se ausentar por at\u00e9 tr\u00eas dias a cada 12 meses de trabalho&nbsp;<\/strong>para realizar exames preventivos de c\u00e2ncer, sem desconto no sal\u00e1rio. Esse limite \u00e9 anual e n\u00e3o \u00e9 acompanhado de muitos detalhes na lei.<\/p>\n\n\n\n<p>\u201cA legisla\u00e7\u00e3o define o direito, o limite e a necessidade de comprova\u00e7\u00e3o, mas n\u00e3o entra em regras operacionais\u201d, explica Marcel Cordeiro.<\/p>\n\n\n\n<p>Isso significa que pontos como aviso pr\u00e9vio, escolha da data ou divis\u00e3o dos dias costumam ser resolvidos no dia a dia, entre a empresa e o funcion\u00e1rio.<\/p>\n\n\n\n<p>A comprova\u00e7\u00e3o, por outro lado, \u00e9&nbsp;<strong>indispens\u00e1vel<\/strong>.&nbsp;O trabalhador precisa apresentar um documento que comprove a realiza\u00e7\u00e3o do exame, embora a lei n\u00e3o especifique qual. Na pr\u00e1tica, uma declara\u00e7\u00e3o de comparecimento costuma ser suficiente.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Quais exames entram na regra?<\/h2>\n\n\n\n<p>Outro ponto que costuma gerar d\u00favida \u00e9 o tipo de exame. A CLT fala de forma ampla em \u201cexames preventivos de c\u00e2ncer\u201d, mas a nova lei destaca que&nbsp;o direito \u00e9 v\u00e1lido para exames de HPV e para os c\u00e2nceres de mama, colo do \u00fatero e pr\u00f3stata, como foco das a\u00e7\u00f5es de conscientiza\u00e7\u00e3o.<\/p>\n\n\n\n<p>Isso significa que<strong>&nbsp;<\/strong><strong>o trabalhador n\u00e3o precisa estar doente para usufruir do direito.<\/strong><\/p>\n\n\n\n<p>A l\u00f3gica \u00e9 justamente a oposta. A lei busca estimular o cuidado antes que problemas mais graves apare\u00e7am, o que pode facilitar o tratamento e reduzir afastamentos prolongados.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">O que ainda falta saber?<\/h2>\n\n\n\n<p>Ainda segundo o advogado Marcel Cordeiro, a nova norma n\u00e3o prev\u00ea uma penalidade espec\u00edfica para empresas que deixarem de cumprir a obriga\u00e7\u00e3o de informar.<\/p>\n\n\n\n<p>Ainda assim, ao incluir esse dever na CLT, o texto aumenta a responsabilidade dos empregadores e tende a dar mais visibilidade ao tema no ambiente de
